Terms of Service

1. Independent Contractor Classification

All workers on TaskCircle operate as independent contractors. TaskCircle does not employ, supervise, or control the manner in which workers perform services. Workers are solely responsible for determining how, when, and where they complete accepted jobs. Nothing in these Terms creates an employment, agency, partnership, or joint venture relationship between TaskCircle and any user.

2. Marketplace Liability Limitation

TaskCircle is a marketplace platform that connects job posters with independent workers within community organizations. TaskCircle is not responsible for the quality, safety, legality, or completion of any job listed or performed through the platform. TaskCircle does not guarantee job outcomes and is not liable for any injuries, property damage, financial loss, or disputes arising between users in connection with jobs facilitated through the platform.

To the maximum extent permitted by applicable law, TaskCircle's total liability to any user for any claims arising out of or relating to the use of the platform shall not exceed the amount of service fees paid by that user to TaskCircle in the twelve (12) months preceding the claim.

3. Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the use of TaskCircle, including the determination of the scope or applicability of this agreement to arbitrate, shall be resolved through binding arbitration administered by a mutually agreed-upon arbitration provider, rather than in court. This arbitration agreement is governed by the Federal Arbitration Act.

Class Action Waiver: All claims must be brought in the parties' individual capacity and not as a plaintiff or class member in any purported class, collective, or representative action. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

Opt-Out: You may opt out of this arbitration provision by sending written notice to TaskCircle within thirty (30) days of creating your account. Opting out will not affect any other aspect of these Terms.

4. Minors and Parental Responsibility

Users aged 14–17 may use TaskCircle only with the consent of a parent or legal guardian. By providing consent during registration, the parent or guardian agrees to these Terms on behalf of the minor and accepts full responsibility for the minor's activity on the platform, including any jobs accepted, posted, or performed.

Parents and guardians are responsible for ensuring that their minor complies with all applicable labor laws, including obtaining any required working papers or employment certificates before accepting paid work. TaskCircle does not verify the existence of working papers and is not liable for any minor's non-compliance with local employment regulations.

5. Waiver of Liability

By creating an account, all users acknowledge that jobs carry inherent risk and agree to hold TaskCircle harmless from any claims, losses, damages, liabilities, and expenses (including attorneys' fees) arising from their use of the platform or participation in any job.

6. Account Suspension and Termination

TaskCircle reserves the right to suspend or terminate any account at any time, with or without cause, including but not limited to violations of these Terms, reports of misconduct, or safety concerns. Suspended users may not create new accounts or use the platform in any capacity during the suspension period.

7. Modifications

TaskCircle reserves the right to modify these Terms at any time. Material changes will be communicated to users via email or platform notification. Continued use of the platform after such notice constitutes acceptance of the modified Terms.
